1. Introduction
Welcome to Design by Nissa (the “Site”). These Terms and Conditions govern your use of designbynissa.com and the purchase of products from our shop. By accessing this website or purchasing art, apparel, or digital goods, you agree to be bound by these terms.
The Site is owned and operated by Nissa Askew (“we,” “us,” or “our”), located in the Cleveland, Ohio area.
2. Products & Services
2.1 Handmade Art (Mirror & Foil Works) Our original artworks are handmade in our Cleveland studio. Due to the nature of materials like acrylic mirror, foil cardstock, and epoxy resin, minor imperfections (bubbles, slight texture variations) may occur. These are not defects but inherent qualities of unique, handmade art. Colors may vary slightly from what you see on your screen due to monitor calibration and the reflective nature of the materials.
2.2 Print-on-Demand Apparel & Accessories We partner with third-party production providers (including Printful) to create and ship our apparel and accessories. These items are made-to-order specifically for you.
– Sizing: Please review the size charts provided on each product page carefully before ordering. Since these items are custom-made, we cannot offer exchanges for wrong sizes.
– Printing: Direct-to-Garment (DTG) printing may have a slightly different texture or color vibrancy than screen printing. This is industry standard.
2.3 Digital Downloads Digital products (such as printable art files) are delivered instantly via email. Due to the nature of digital goods, all sales of digital files are final and non-refundable.
3. Orders & Payment
We reserve the right to refuse any order you place with us. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail provided at the time the order was made.
Prices for our products are subject to change without notice. We reserve the right to modify or discontinue the Service (or any part thereof) without notice at any time.
4. Shipping & Delivery
4.1 Split Shipments Because we operate a hybrid shop, your order may arrive in multiple packages.
– Original Art: Ships directly from our studio in Cleveland, Ohio.
– Apparel/Merch: Ships directly from our print providers (locations vary across the USA).
4.2 Processing Times
– Ready-to-Ship Art: Typically ships within 3-5 business days.
– Print-on-Demand: Production typically takes 2-7 business days before shipping.
4.3 International Shipping We are not responsible for any customs and taxes applied to your order. All fees imposed during or after shipping are the responsibility of the customer (tariffs, taxes, etc.).
5. Returns & Refunds
5.1 Print-on-Demand Items Since apparel and accessories are made to order, we do not accept returns or exchanges for buyer’s remorse or sizing errors.
Damaged/Defective Items: If your item arrives damaged or with a print error, please contact us at hello@designbynissa.com,or fill out this contact form, within 7 days of delivery with a clear photo of the issue. We will arrange for a free replacement or refund.
5.2 Original Art All sales of original artwork are final unless the item arrives damaged.
Damage in Transit: If your painting arrives damaged, please photograph the packaging and the damage immediately and contact us within 48 hours so we can file a claim with the carrier and resolve the issue.
5.3 Commissions Custom commissions require a non-refundable deposit. Once the final design is approved and production begins, the remaining balance is non-refundable.
6. Intellectual Property & Website Content
Original Artwork: All original handmade artwork, designs, and digital prints sold by Design By Nissa are the exclusive intellectual property of Nissa Askew and are protected by United States and International copyright laws. Purchasing a physical piece of art or digital download does not transfer the copyright to the buyer. You may not reproduce, scan, alter, or resell reproductions of the artwork without express written permission from the artist.
Website Assets & AI Transparency: To provide an engaging shopping experience, some supplementary website materials, such as lifestyle product mockups, background staging images, and website copy, may be generated or enhanced using Artificial Intelligence tools. These specific promotional assets are utilized strictly for display purposes and do not alter the fully original, human-crafted nature of the physical and digital artwork sold by Design By Nissa.
7. Limitation of Liability
Design By Nissa shall not be liable for any special or consequential damages that result from the use of, or the inability to use, the materials on this site or the performance of the products, even if Design By Nissa has been advised of the possibility of such damages.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions.
9. Customer Reviews & Communications
9.1 – Review Invitations: By purchasing from Design by Nissa, you agree that we may send you an automated email invitation to review your order. These invitations are sent via a third-party service (Customer Reviews for WooCommerce) to help us improve our products. You can opt-out of these invitations at any time by clicking the “Unsubscribe” link at the bottom of any review email.
9.2 – User-Generated Content: If you submit a review, including any text or photos of your art or apparel, you grant Design by Nissa a non-exclusive, royalty-free right to display that content on our website and social media for marketing purposes. You represent that you own the rights to any media you upload. We reserve the right to remove any reviews that are off-topic or offensive.
9.3 – Data Sharing: To send these invitations, we share your name, email address, and order details with the Customer Reviews for WooCommerce (CusRev) service. This data is used strictly for the purpose of gathering feedback on your purchase.
